Meetup Beta Terms of Service

Effective Date: October 23, 2023

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY. BY PARTICIPATING IN THE MEETUP BETA PROGRAM, YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS AND ALL TERMS INCORPORATED BY REFERENCE AS DESCRIBED BELOW. IF YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS, YOU MAY NOT PARTICIPATE IN THE MEETUP BETA PROGRAM.

These Meetup Terms and Conditions (“Meetup Terms”) apply to your access to and participation in the Meetup Beta program (“Meetup Beta”), which is operated by Mercari, Inc. or its affiliates (collectively, ”Mercari”, ”our”, ”us” or ”we”). These Meetup Terms do not alter in any way the terms or conditions of any other agreement you may have with Mercari for other products and services. Please note that your access to and participation in the Meetup Beta is also governed by the terms, conditions, limitations, and requirements linked in these Meetup Terms, all of which (as may be changed over time) are incorporated into these Meetup Terms. In addition, these Meetup Terms complement and incorporate by reference the Mercari Terms of Service (“Mercari Terms”). Except as may be expressly stated in these Meetup Terms, in the event of any conflict between the Mercari Terms and these Meetup Terms, the Mercari Terms will control.

Mercari reserves the right to change, modify or eliminate Meetup Beta or all or any portion of these Meetup Terms or any policy pertaining to Meetup Beta at any time and in our sole discretion, including our right to discontinue, change the features or change the operation of Meetup Beta. If we make changes, we will post the amended Meetup Terms to the Meetup Beta Program Terms and Conditions page and update the “Effective Date” above. We may also attempt to notify you in other ways. Unless we say otherwise, the amended Meetup Terms will be effective immediately and your continued participation in Mercari Meetup after the amended terms are posted will confirm your acceptance of the changes. If you do not agree to the amended Meetup Terms, you must stop participating in Mercari Meetup.

Meetup Beta Program Eligibility

You must be at least 18 years of age to participate in the Meetup Beta program and must live in one of the eligible area codes located in the greater Los Angeles area. A list of eligible area codes for participation in the Meetup Beta can be found here.

The location of the buyer and seller are approximate in nature and are determined using the zip code of the buyer and seller which are either: (i) provided directly to Mercari by the buyer or seller; or (ii) determined via the IP address of the buyer or seller’s device used to access the internet (mobile device or pc). Mercari uses zip codes to approximate the location of the buyer and seller and does not use precise geolocation methods, such as GPS coordinates, to determine the location of the buyer and seller. The distance between buyer and seller is the approximate distance based upon the point-to-point distance calculated from the center of the zip code where the buyer and seller are believed to be located.

In connection with a Meetup Beta proposed transaction, the buyer or seller can reject the invitation to participate in a face-to-face transaction. There is no obligation to meet face-to-face with another user on the platform and your participation in a Meetup Beta transaction is voluntary. If the buyer or seller decides to reject the Meetup Beta invitation, the buyer and seller can still decide to proceed with a normal online Mercari transaction.

Mercari Meetup Buying and Selling

Currently, a buyer and seller as part of Meetup Beta may decide to pay for items outside of the Mercari service, such as via cash or other agreed upon payment method when they complete their transaction as part of a meetup. Mercari is not a party to such a transaction, is not facilitating such a transaction and therefore is not able to assist with refunds or returns related to such transaction in any manner.

Solely in connection with your participation in the Meetup Beta program, the following actions within the Transaction section of the Mercari Prohibited Conduct policy shall not apply: (i) encouraging payments outside of Mercari; (ii) proposing or completing a transaction in person; and (iii) proposing payment for all of the item on delivery.

Furthermore, solely in connection with the Meetup Beta program, the following within the Solicitation section of the Mercari Prohibited Conduct policy shall not apply: (i) soliciting users to provide personal information. Please be cautious regarding the personal information that you decide to share with other Mercari users in connection with a Meetup Beta transaction. Extended warranty protection offered through Consumer Priority Service are not available for Meetup Beta transactions.

The full Mercari Prohibited Conduct policy terms shall continue to apply to online Mercari transactions.

Mercari Meetup Transactions are not eligible for Mercari’s Refunds and Returns policy, shipping protection, Buyer Protection or Seller Protection. Buyer should carefully review the item purchased before completing the transaction. Any dispute related to such a transaction is solely between buyer and seller.

Assumption of Risk

YOU ACKNOWLEDGE AND AGREE THAT THERE ARE RISKS ASSOCIATED WITH INTERACTING WITH OTHER USERS ON A MARKETPLACE PLATFORM. MERCARI DOES NOT INVESTIGATE OR VERIFY ANY USER’S REPUTATION, CONDUCT, MORALITY, CRIMINAL BACKGROUND OR ANY INFORMATION THAT A USER MAY SUBMIT TO MERCARI (EXCEPT AS MAY BE REQUIRED BY LAW OR REGULATION IN CONNECTION WITH MERCARI’S STATUS AS AN ONLINE MARKETPLACE AND MONEY TRANSMITTER). ANY PERSONAL INFORMATION THAT YOU PROVIDE TO ANOTHER USER ON THE PLATFORM IN ORDER TO COMPLETE A MEETUP BETA TRANSACTION IS DONE VOLUNTARILY AND YOU ASSUME ALL RISK IN CONNECTION WITH THE DISCLOSURE OF SUCH PERSONAL INFORMATION. YOU ARE SOLELY RESPONSIBLE FOR TAKING ALL NECESSARY PRECAUTIONS WHEN INTERACTING WITH OTHER USERS, PARTICULARLY WHEN MEETING A STRANGER IN PERSON. IT IS POSSIBLE THAT OTHER USERS MAY ATTEMPT TO PHYSICALLY HARM OR DEFRAUD YOU OR OBTAIN INFORMATION FROM YOU FOR FRAUDULENT PURPOSES, YOU ARE SOLELY RESPONSIBLE FOR, AND ASSUME ALL RISKS RELATED TO SELLING AND BUYING THROUGH OFFLINE TRANSACTIONS WITH OTHER USERS.

Miscellaneous

Without notice to you, Mercari reserves the right to suspend or terminate your participation in Meetup Beta (in whole or in part), if Mercari determines in its sole discretion that you have violated these Meetup Terms, your Mercari account is no longer in good standing, or your participation in Meetup Beta is unauthorized, abusive, deceptive, fraudulent or otherwise unlawful. Mercari may, in its sole discretion, suspend, or cancel the Meetup Beta.
